ERFPOs (Extreme Risk Firearm Protection Orders) are accessible to all New Mexicans and are designed for to help protect both the individual and those around them.

What is an ERFPO?

An Extreme Risk Firearm Protection Order (ERFPO) is a civil court order. It temporarily removes firearms from a person who may harm themselves or others.

How Do ERFPOs Work?

To request an ERFPO, talk to law enforcement. An officer begins the process and takes the information to the court.

In 2025, Governor Michelle Lujan Grisham signed a new ERFPO law that makes it easier for families to use this process. Family members do not have to appear in court. Instead, a law enforcement officer can present the information for them.

Step 1:

Speak with law enforcement

Tell an officer why you are worried. Share what you know about threats, behavior, or access to guns.

Step 2:

The officer files a request

The officer petitions the court to temporarily limit the person’s access to firearms. The request is based on information from the officer and others.

Step 3:

A judge reviews the facts

The judge looks at the past year for:

  • Acts or threats of violence
  • Mental health information
  • Criminal record
  • Any cruelty to animals
  • Sudden or unusual gun purchases, or attempts to buy guns

Step 4:

Temporary order (10 days)

If approved, a temporary order lasts ten days. All firearms must be turned in to law enforcement for safe storage. No new firearms can be acquired while this order is in place.

Step 5:

Court hearing

There is a court hearing. Anyone may appear and be heard by the judge.

Step 6:

Final order (up to 1 year)

After the hearing, the judge may issue a final order that lasts one year or may decide not to issue a final order if the risk has passed. The court can reduce the length or extend it.
